Terms of service
The Gathering of Men is operated by The Embodied Man Institute.
These Terms govern your use of thegatheringofmen.com and the content, courses, community, events and paid offerings (the "Services") provided by The Embodied Man Institute ("we", "us", "our"). By creating an account or making a purchase, you agree to these Terms. If you do not agree, do not use the Services. Questions are welcome at contact@theembodiedmaninstitute.com.
1. Your account
You must give accurate information and keep your login credentials secure. You are responsible for activity under your account. You must be at least 16 to use the Services, and if you are under 18 you confirm you have your parent or guardian's permission. We may suspend or close an account that breaches these Terms or is used unlawfully.
2. Purchases and payments
Prices are shown at checkout in the displayed currency. Payments are processed securely by Stripe. We are the seller and merchant of record, and by purchasing you also agree to Stripe's applicable terms. Subscriptions and payment plans renew automatically each period until cancelled. You can cancel any time before the next renewal via your account or by contacting us at contact@theembodiedmaninstitute.com. Cancellation stops future charges and ends access at the end of the paid period unless stated otherwise.
3. Refunds
Any refund policy stated at purchase applies in addition to your rights under the Australian Consumer Law, never instead of them. Nothing in these Terms excludes, restricts or modifies the consumer guarantees or any other right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where those guarantees apply, you may be entitled to a refund, repair, replacement or other remedy regardless of any stated policy.
4. Payment disputes
If you believe a charge is wrong, contact us first at contact@theembodiedmaninstitute.com so we can resolve it. Initiating a chargeback with your bank does not remove any amount you genuinely owe us, and where the charge was valid we may revoke access and recover the disputed amount and any associated fees. This does not limit any genuine remedy you have under the Australian Consumer Law.
5. Access to content, community and events
When you buy an offer, we grant you a personal, non-transferable, non-exclusive licence to access the relevant content for the period and on the terms described at purchase. Access is per person. Do not share your login or redistribute paid content. Live and streamed sessions may be recorded, and replays, where offered, are available for the stated window. If you take part in a live session, including by camera, microphone or chat, you consent to being recorded. Tell us before a session if you do not want to appear and we will accommodate reasonable requests. We may revoke access where payment is reversed or refunded, where a subscription lapses, or where you materially breach these Terms.
6. Acceptable use
You agree not to copy, resell or redistribute our paid content, share your account, harass or abuse other members or staff, post unlawful, infringing or harmful content, attempt to breach the security of the Services, send unsolicited or bulk messages to other members, or use the Services for any unlawful purpose. We may remove content or restrict access that breaches this section.
7. Communications
By creating an account or making a purchase, you consent to us sending you service messages about your purchases and account. With your consent we may also send you marketing. You can opt out of marketing at any time using the unsubscribe link in any message, and we will action your request within 5 business days. Service messages necessary to provide the Services will continue.
8. Community conduct
If the Services include a community, you are responsible for what you post. Do not post anything unlawful, infringing, hateful, harassing or misleading. Moderators may edit, hide or remove content and restrict or remove members who breach these Terms.
9. Intellectual property
We or our licensors own the Services and all content we provide. Your purchase grants a licence to use it, not ownership. You keep ownership of content you post, and you grant us a non-exclusive, royalty-free, worldwide licence to host, store, reproduce and display it as needed to provide the Services. We will ask your permission before using your content in marketing.
10. Our content
Our content is educational coaching material. Unless we expressly say so, it is not professional financial, medical, legal or psychological advice, and results vary. We do not guarantee any particular outcome. This does not limit your consumer guarantee rights.
11. Liability
Nothing in these Terms limits any right or remedy you have under the Australian Consumer Law that cannot lawfully be limited. Subject to that, and to the maximum extent permitted by law, we are not liable for indirect or consequential loss, and for any liability that can lawfully be limited, our total liability to you for all claims relating to a Service is limited to the total amount you have paid us for that Service in the 12 months before the first event giving rise to the claim. We are not responsible for failures or delays caused by events outside our reasonable control, but we will act reasonably to restore the Services.
12. Privacy
Your personal information is handled under our Privacy Policy, which forms part of these Terms.
13. Termination
You can stop using the Services at any time. We may suspend or terminate your access if you materially breach these Terms and, where the breach can be fixed, you do not fix it within a reasonable time after we ask, or where required by law. On termination, paid access ends and any amounts properly due up to termination remain payable.
14. Changes
We may update these Terms from time to time. Changes apply from when they take effect and do not retrospectively affect amounts already paid or a fixed-term offer you have already purchased for that term. For any change that materially and adversely affects you, we will give you reasonable advance notice. If you do not agree to the change, you may stop using the Services and cancel before it takes effect.
15. Governing law
These Terms are governed by the laws of Australia. If any part of these Terms is unenforceable, it is severed and the rest continues in force.
